PARKS AND PLAYGROUNDS
(Ord. No. 16)
 
THE BOARD OF BERRIEN TOWNSHIP ORDAINS:
 
120.001           Park Board.
 
Sec. 1. The Township Board is a Park Board and they make such rules and regulations pertaining to the conduct and use of the Township park as are necessary to administer the same or to protect public property or the safety, health, morals, welfare of the public; any person failing to comply with such rules or regulations shall be subject to penalties in Section 11 [120.011].

120.002           Caretaker.
 
Sec. 2. The Park Board shall appoint a caretaker to regulate the require­ments of this Ordinance with compensation set by the Park Board.

120.003           Obstruction, destruction of property.
 
Sec. 3. No person shall obstruct any walk or drive in any public park or playground, nor shall any person damage, deface, destroy, move or carry away any sign, structure, building, playground equipment, tool, device, tree, shrub, flower or other public property located therein or used in connection therewith.

120.004           Littering.
 
Sec. 4. No person shall throw, place, deposit or leave any garbage, rubbish, glass, cans, containers, paper or other waste in any public park or playground, except in containers provided by Berrien Township for that purpose.

120.005           Fires.
 
Sec. 5. No person shall build any fire in any public park or playground except in fireplaces or other spaces set apart and designated for that purpose.

120.006           Disorderly conduct.
 
Sec. 6. No person shall:
 
(a)    Jostle or crowd another in any public park nor throw any ball or other object in such a manner as to annoy or endanger other persons in or on such park or playground, nor engage in any violence or rough play therein.
(b)   Cause any disturbance or contention in any public building, grounds, park, or other public meeting where citizens are peaceably and lawfully assem­bled.
(c)    Annoy, interrupt or disturb any assembly for religious worship. (Ord. No. 16, Eff. July 29, 1988)
 
120.007           Vehicles; horses.
 
Sec. 7. No person shall park any vehicle except at such places and in such manner as may be established by the Township Board of Trustees and indicated by signs and limit lines, and no person shall park any vehicle at any place where parking is prohibited by signs posted by the Township Board of Trustees. No horses, motorbikes, snowmobiles, go-carts shall be ridden within the Township parks, unless otherwise posted. The word "vehicle" as used in this section of this Ordinance is meant to include both vehicles and trailers of any kind or description including all types of amphibious vehicles, tractors, bulldozers, whether operating on track, wheels, or air and any and all other types of vehicles or trailers, whether motor driven, self-propelled, or drawn by another vehicle and shall include toboggans, sleds and sleighs, motorbikes, snowmobiles, bicycles, automobiles, go-carts and trailers.

120.008           Pavilion; rules and regulations.
 
Sec. 8. The Township Board of Trustees is hereby authorized to lease -the pavilion and to promulgate reasonable rules and regulations respecting the use of public parks or playgrounds and may regulate and limit the use of the equipment and facilities therein. The Township Board of Trustees shall post all other rules and regulations promulgated at the entrance to· each Township park or play­ground and said posted rules and regulations shall be incorporated and be made a part of this Ordinance and shall be enforced as if they were specifically numerated herein. The Township Board of Trustees shall have the authority to forbid the use of the equipment and facilities in any such park or playground to any person who refuses or neglects to obey the rules and regulations governing the use thereof.

120.009           Applicability of ordinance.
 
Sec. 9. This Ordinance shall extend to and include all public parks and playgrounds owned by or under the jurisdiction of Berrien Township or any Board or Department thereof.

120.010           Validity; repeal.
 
Sec. 10. Should any section, clause or provision of this Ordinance be declared by a court to be invalid, the same shall not affect the validity of the Ordinance as a whole, or any part thereof, other than the parts so declared to be invalid. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.

120.011           Penalty.
 
Sec. 11. Any person violating or failing or refusing to comply with any of the provisions of this Ordinance and the posted rules and regulations shall be guilty of a misdemeanor, and upon conviction of a violation of any provision of this Ordinance or the posted rules and regulations, shall be punished by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment not to exceed ninety (90) days, or both such fine and imprisonment, at the discretion of the Court. Each violation, failure or refusal to comply with the provisions of this Ordinance or the posted rules and regulations shall constitute a separate offense.

120.012           Effective date.
 
Sec. 12. This Ordinance shall become effective thirty (30) days from and after its adoption and publication.

120.013           Adoption.
 
Sec. 13. This Ordinance is hereby declared to have been adopted by the Township Board of the Township of Berrien, County of Berrien, State of Michigan, at a meeting thereof duly called and held on the 14th day of June, A. D. 1988, and ordered to be given publication in the manner prescribed by law.
 
120.014           Rules for Township parks and playgrounds.
 
1.      Park is open from 8:00 A.M. until sunset.
2.      Speed limit 5 M.P.H.
3.      No motorized vehicles off roadways.
4.      The possession or use of drugs or alcohol shall be prohibited.
5.      No camping.
6.      No open fire except by caretaker permission.
7.      No hunting or firearms.
8.      No littering.
9.      No dogs are allowed.
10. No snowmobiling or horseback riding.
11. Use of playground with adult supervision only.
12. The pavilion may be reserved by Township residents only through Township Clerk's office.
