MEETING MINUTES
Monday, March 13, 2017
 
 
CALL TO ORDER
 
The Berrien Township Planning Commission met on Monday, March 13, 2017 at 7:00 p.m. for a regular meeting.  Vice Chairman Ron Harner called the meeting to order and opened with the Pledge of Allegiance to the American Flag.
 
 
ROLL CALL
 
Planning Commission Members Present:  Vice Chairman - Ron Harner, Secretary - Doug Shelton, Julie Burke, Chris Sill
 
Members Absent: Chairman - Karen O’Dell, David Riedlinger and Dale Sherwood
 
Others Present:  Building Inspector - Ross Rogien, Supervisor - Bryan Bixby, and Recording Secretary - Rebecca Stephenson, Mr. & Mrs. David Ferguson, Chuck Schmidt, Brian Mainguy and 3 residents.
 
 
MINUTES
 
Motion by Doug Shelton, supported by Chris Sill, to approve minutes from the December 15, 2016 meeting of the Planning Commission.  All ayes, none opposed.  Motion carried. 
 
 
BUILDING PERMITS
 
There were no building permits issued in February 2017. One (1) electrical permit was issued with total fees of $143.00.
 
 
PUBLIC HEARING 
 
The meeting was recessed to open the 7:05 p.m. Public Hearing.
 
Special Use Request #17-001, Chuck Schmidt, 6892 E. Main St., 11-04-0004-0019-01-8
 
Chuck Schmidt the operator of The Parlor Tattooing, LLC located at 6892 E. Main Street made a brief presentation about his business. He stated the operation hours are Monday through Saturday from 1:00 p.m. to 9:00 p.m. They have regular inspections from the Health Department. They are under the same criteria as doctor offices and hospitals.  Many of their clientele is law enforcement.
 
Mr. Ferguson, owner of the property, stated that the business is clean and has been run well. The business has been open since the first of the year. He had been unaware that a Special Use was needed. He stated that he is happy to comply.
 
There was one letter which was read aloud by Secretary Shelton and two phone calls received by residents regarding this request. Each expressed support in reference to the business.
 
Public Hearing closed at 7:09 p.m.  The Planning Commission meeting reconvened.
 
Doug Shelton read the Definition of “Personal Services”; services provided to an individual such as barbershops, beauty salons, shoe repair, tailors, dressmaking and such. 
The board agreed that a tattoo parlor would be classified under “Personal Services”.
 
Julie Burke read the Planning Commission findings and standards for recommendation Article Eleven 300.1101 from the Zoning Ordinance and it was agreed that all conditions and standards were met in this situation.
 
Motion by Doug Shelton, supported by Chris Sill, to recommend for approval to the township board Special Use Request #17-001 to owner Mr. David Ferguson for property at 6892 E. Main Street Eau Claire under 300.602 Personal Services with the stipulation that the Township be informed on any changes with the tenancy.  All ayes, none opposed.  Motion carried. 
 
 
NEW BUSINESS
 
2017 – 2018 Schedule of Meeting Dates:
The meeting dates were reviewed for the next fiscal year.  It was agreed to change the August meeting to the first Monday (August 7th) of the month in order to avoid any conflicts with the Berrien County Youth Fair.
 
Motion by Julie Burke, supported by Doug Shelton, to approve the 2017-2018 meeting dates with the August revision.   All ayes, none opposed.  Motion carried.
 
 
Election of Officers:
 
Motion by Julie Burke, supported by Ron Harner, to nominate Karen O’Dell as Chairman.
All ayes, none opposed.  Motion carried.
 
Motion by Doug Shelton, supported by Chris Sill, to nominate Ron Harner as
Vice-Chairman.  All ayes, none opposed.  Harner abstained.  Motion carried.
 
Motion by Julie Burke, supported by Ron Harner, to nominate Doug Shelton as Secretary.  All ayes, none opposed.  Shelton abstained.  Motion carried.
 
 
 
ADJOURNMENT
 
Motion by Julie Burke, supported by Doug Shelton, to adjourn the meeting.  All ayes, none opposed.  Motion carried.  Meeting adjourned at 7:25 p.m.
