BERRIEN TOWNSHIP
JANUARY 12, 2016 MINUTES
 
The Berrien Township Board of Trustees met on Tuesday, January 12, 2016 at 7:00 p.m. at the township hall.  Supervisor Bryan Bixby called the meeting to order and opened with the pledge to the flag.
 
Members present:  Supervisor Bryan Bixby, Treasurer Paul Sprung, Trustees Julie Burke, Howard Henderson, Jeff Marks, Harold Bishop and Clerk Mary Jane Dean.
 
Also present:  Deputy Supervisor Julius Grau, Building Inspector Ross Rogien, Fire Chief Tom Stiles, reporter Mary Simko and two residents.
 
AGENDA:
Paul Sprung made a motion seconded by Julie Burke to approve the agenda.  All ayes, none opposed.  MOTION CARRIED.
 
MINUTES:
Paul Sprung made a motion seconded by Howard Henderson to approve the December 8, 2015 minutes as presented.  All ayes, none opposed.  MOTION CARRIED.
 
TOWNSHIP BILLS:
Julie Burke made a motion seconded by Howard Henderson to approve the township bills of $22,443.70 for payment.  An invoice is needed for the cameras the cost for under $1,200.00 has been approved. All ayes, none opposed.  MOTION CARRIED.
 
FIRE BILLS:
Julie Burke made a motion seconded by Mary Jane Dean to approve the joint fire bills in the amount of $18,886.39 with the township share of $12,200.60 for payment.  All ayes, none opposed.  MOTION CARRIED.
 
TOWNSHIP ROADS:
The annual meeting with the Road Commission will be Wednesday, March 2, 2016 at 9:00 a.m. The estimated amount for 2016 road projects was set at $122,000.00.
 
PARK COMMITTEE:
The committee hasn’t met as the revisions are still being completed hopefully will meet in February.
 
UNION CHURCH:
Supervisor reported he has started working on the project for painting the church he has been looking at the previous bids.  The Niles firm is still willing to donate the paint.
 
SCHRAMM PROPERTY:
Last month the Board gave Ramzi Saad one week to get a purchase agreement signed. If not the bid for the demolition would be given to the lowest bidder (Rick Rankel for $8,700.00).  The owner Daniel Schramm has signed the purchasing agreement but a title search was done and showed that Bradley Schramm (original owner) ex-wife needs to sign the papers to get her name off the deed (she has no financial lien on the property) apparently it wasn’t either done or wasn’t recorded when they were divorced. She is out of the country and he can’t get a hold of her.  Supervisor stated the Board should go ahead with the demolition as we decided last month.  Paul Sprung made a motion seconded by Harold Bishop to table the discussion until the February meeting this would allow Ramzi more time.  All ayes, none opposed.  MOTION CARRIED.   
 
FRANKLIN CHURCH: 
Dean Clerk reported that she hadn’t heard back from Jennifer (St. Joe Monuments) as to any figures for the cost of the vandalism.  Ferguson did the trench last week for the cables.  For insurance purposes someone must own the church.  We need to get a title search done even though the Church of the United Brethren in Christ gave the church to the Franklin Church Association nothing was ever recorded.
 
DEFAY SPECIAL USE REQUEST: 11-04-0009-0014-02-5
The Board received a special use request from Cindy DeFay to operate a catering business at 8665 Huckleberry Rd. A public hearing was held on December 14, 2015.  There would be no customers or delivery trucks going in or out of the business.  She would have only two part time employees and the business is seasonal. She will not have a business sign on the property. She has been in the catering business for 20 years. 
The Planning Commission recommended the special use be approved with no restrictions. For more details refer to #15-002 special use file.  Paul Sprung made a motion seconded by Howard Henderson to approve the special use request to be located on Huckleberry Rd.  All ayes, none opposed.  MOTION CARRIED.
 
PROPERTY TAX POVERTY RESOLUTION:  01-2016      
Paul Sprung made a motion seconded by Harold Bishop to approve the resolution updating state required poverty level income standards for property tax poverty exemption guidelines for tax year 2016.  Roll call vote:  Paul Sprung, Harold Bishop, Jeff Marks, Julie Burke, Howard Henderson, Mary Jane Dean, and Bryan Bixby all yes votes.  Seven yes votes, none opposed, none absent.  MOTION CARRIED.
 
ACCEPTING LETTERS RESOLUTION: 02-2016
Mary Jane Dean made a motion seconded by Julie Burke to approve the Resolution: 02-2016 for accepting letters of protest from township residents for March 2016 Board of Review. Roll call vote:  Mary Jane Dean, Julie Burke, Paul Sprung, Jeff Marks, Harold Bishop, Howard Henderson and Bryan Bixby all yes votes.  Seven yes votes, none opposed, none absent.  MOTION CARRIED.
 
ALTERNATE STARTING DATES RESOLUTION: 03-2016    
Paul Sprung made a motion seconded by Mary Jane Dean to approve the Resolution 03-2016 to provide for alternate starting dates for March 2016 Board of Review. Roll call vote:  Paul Sprung, Mary Jane Dean, Howard Henderson, Julie Burke, Jeff Marks, Harold Bishop and Bryan Bixby all yes votes.  Seven yes votes, none opposed, none absent.  MOTION CARRIED.
 
FIRE REPORT:
Fire Chief reported that the Dept. had 10 calls for the month of December with labor cost of $1,403.00.  January thru December there were 139 calls with 97.5 Berrien Township’s and 41.5 Pipestone Township’s for a total labor cost $21,105.00.  Chief Tom stated that this would be his last meeting as Fire Chief.  Supervisor and the Board thanked Tom for his many years of service and the last 13 yrs. as Fire Chief.  The Annual Joint Fire meeting will be February 17, 2016 at 7:00 p.m. at the main fire station.
 
BUILDING and ELECTRICAL PERMITS:
Building Inspector issued (5) building permits which included (2) new homes for an estimated amount of $393,000.00 for the month of December.  Electrical Inspector finalized (5) electrical permits for a fee of $524.00. 
 
EMERGENCY MANAGEMENT: NO MTG.
 
PLANNING COMMISSION: NO MTG.
 
FINANCIAL REPORT:
Treasurer Sprung reported that the revenue from April thru December was $327,172.93 with Dec. at $34,964.33.  Expenses April thru December was $483,720.54 with Dec. at $43,627.71 leaving a deficit of $156,547.61. He anticipates revenue to be $160,000.00 over expenses for the last 3 months of the fiscal year.  Mary Jane Dean made a motion seconded by Julie Burke to increase the cost center for Zoning Board of Appeals to $460.00.  All ayes, none opposed.  MOTION CARRIED.
 
With no further business the Supervisor adjourned the meeting at 8:07 p.m.
